Terms of Service

By posting or handing your photographs, slides, negatives, photo albums, documents, video or audio tapes to Scanorama, you agree to the Terms of Service below. These Terms of Service do not affect the customers’ statutory rights.

1. Application

These Terms of Service will apply to the purchase of goods and services by you (the Customer or you).  We are Scanorama of 27 Rib Vale, Hertford, Herts. SG14 3LE with email address peter@scanoramastudios.co.uk and telephone number 07410 635337 (the Supplier or us or we).

These are the terms on which we sell all goods and services to you. By ordering any of the goods and services, you agree to be bound by these Terms and Conditions. You can only purchase goods and services from Scanorama if you are eligible to enter into a contract and are at least 18 years old.

2. Contract Commencement

No contract will exist between you and Scanorama for the supply of goods and services unless and until Scanorama accepts your order by sending you an order confirmation e-mail.

3. The Contract

These Terms and Conditions govern the sale and provision of Scanoramas goods and services and will form the basis of the contract between you (the Customer) and Scanorama.

Under the contract, Scanorama will provide the goods and services and you will pay for them in accordance with the terms set out in these Terms and Conditions. Before submitting an order please ensure that you have read these Terms and Conditions carefully.

 

4. Payment for Goods and Services

Payment for goods and services offered by Scanorama is normally requested in full upon completion of the digitisation services. An invoice will be sent to the customer by electronic means, detailing the goods and services provided and requesting payment in full by either bank transfer or cheque. After payment has been received, the original media and the digitised files will be returned to the customer, either by courier, personally or by digital download from a secure third-party server.

At the discretion of Scanorama, particularly for orders of a substantial volume of work, a deposit of not more than 50% of the total order value will be requested before the order proceeds.

 

5. Cancellation

An order may be cancelled by sending an email to peter@scanoramastudios.co.uk or by calling 07410 635337.

If the order has already commenced, then the customer will be charged a fee in proportion to the amount of the order that has been processed, and the return postage fee.

Scanorama reserve the right to cancel your order at any given time and refund any payment already made in full.

 

6. Shipping

Scanorama may at times personally collect and return a customers’ media for digitisation from/to the customers’ home address or business address. This personal service is offered at the discretion of Scanorama. A separate charge for this service will be made and added to the final invoice. This charge is calculated on the road mileage between the customers’ premises and the Scanorama business address.

Scanorama reserve the right to vary the chargeable rate for this service from time to time. Scanorama may, at our discretion, also request a small deposit to be paid before your items are collected.

When a customer is posting their order to Scanorama themselves, they are responsible for making their own arrangements and are responsible for the costs incurred.

Return postage charges will be added to the final invoice.

Orders will be shipped back to customers via the Royal Mail ‘Tracked and Signed For’ service, or a courier service such as UPS who also offer a Signature Tracking service.

7. Security

Scanorama accepts no responsibility arising from lost, damaged or delayed items while in transit to or from us. We will always obtain a posting receipt and notify you once we have received or dispatched your photographic materials and other media submitted for digitisation.

Scanorama shall not be liable for any damage or malfunction of the original source material which occurred prior to submission to Scanorama.

No monetary value can be placed on your photographic media, video and audio tapes or other documents for insurance purposes, therefore no claims for compensation resulting from loss, damage or theft of your materials while they are at the Scanorama premises, or in transit to/from you, the customer, in a private vehicle used by Scanorama, will be considered.

Scanorama will take every opportunity to protect your materials from the aforementioned threats.

 

8. Confidentiality

Scanorama will undertake to never publish any of your photos, video or audio recordings or any other of your submitted documents on any of our websites and to never pass any of your media on to a third-party company, with the sole exception being the uploading of your media to a secure server operated by WeTransfer.com should you request the service of digitally downloading your order.

When a period of 30 days has passed from completion of your order (as defined by full payment having been received by Scanorama), we will irretrievably erase all of your photographic images, video and audio recordings and any other digitised documents from our own secure storage system and we will instruct WeTransfer.com to do the same.

 

9. Photographic and other Media Content

By becoming a customer of Scanorama, the customer agrees to become solely responsible for ensuring that all photographs, video recordings, audio tapes and other documents submitted for digitisation do not infringe any criminal or civil law.

The physical documents that make up your photographs, video and audio recordings as well as any other documents submitted for digitisation remain your property at all times, as do the copyright and ownership of the images, recordings and documents themselves.

You, the customer, are solely responsible for ensuring that you are not risking any copyright violation and you agree to indemnify Scanorama against any charges due to unforeseen copyright infringement of material supplied to Scanorama. Scanorama will not process any material that we suspect to be inappropriate or offensive.

10. Quality of Work

It should be noted that the quality of the scanned and digitised work will always be dependent on the quality of the original submitted material.

Scanorama will always aspire to produce the highest quality of work possible, however Scanorama cannot be held responsible for failing to scan or otherwise digitise any image, video or audio tape or document to a satisfactory level if the damage to the original is deemed too great or the quality of the submitted media is too poor.

 

11. Prices

The prices of the services offered by Scanorama shall be those stipulated on the Scanoramastudios.co.uk website, errors and omissions excepted.

For the period of time between you placing an order with Scanorama, and the completion and invoicing of that order, Scanorama will not change any of the prices as described in our initial quote or correspondence.

We reserve the right at any time to modify or discontinue the service, or any part or content thereof, without notice at any time.

We shall not be liable to you or any third-party for any modification, suspension or discontinuance of any of our services.

 

12. Complaints

In the unlikely event of a customer complaint, all communications should be sent to peter@scanoramastudios.co.uk or by telephoning 07410 635337.

Scanorama will investigate and attempt to resolve any issues as a priority. We have very high standards throughout all of our working practices and we will endeavour to resolve the issue to your complete satisfaction.

Scanorama are not able to provide any financial compensation other than a partial refund of monies paid to Scanorama by the customer.
